RESOLUTION NO. 2003-3216

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS AMENDING AND SUPPLEMENTING CODE OF ORDINANCE SECTION 101-01, SUPPLEMENTAL CODE ENFORCEMENT CITATION SYSTEM, BY ADDING THERETO CITY CODE OF ORDINANCE SECTION 93.50 TO THE APPENDIX OF CIVIL INFRACTION CODE SECTIONS AND CIVIL PENALTIES FOR VIOLATION CONTAINED THEREIN; EFFECTIVE DATE.

WHEREAS, the City authorized the creation and enactment of a Supplemental Code Enforcement Citation System in 1996; and,

WHEREAS, the aforesaid "ticketing system" was codified as Section 101-01 of the Code of Ordinances and included an Appendix of Civil Infraction Code Sections and Civil Penalties for Violation; and,

WHEREAS, contained within Subsection 101-01(I) is a provision that authorizes the City Council, by Resolution, to add, delete, amend and clarify or supplement the Civil Infraction Sections and Civil Penalties; and,

WHEREAS, the Code Enforcement Department has recently become aware of the fact that the City's Ordinance regulating garage sales is not included within the aforesaid Appendix; and,

WHEREAS, the City Council of the City of Miami Springs has determined that it is both proper and appropriate to add Code of Ordinance Section 93.50, relating to garage sales, to the Appendix of Civil Infractions and Penalties enforced pursuant to Code of Ordinance Section 101-01:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS, FLORIDA:

Section 1: That the City Council of the City of Miami Springs hereby resolves that the Appendix provided in Code of Ordinance Section 101-01, Supplemental Code Enforcement Citation System, for "Civil Infraction Code Sections and Civil Penalties for Violation" is hereby supplemented by adding thereto the following City of Miami Springs Code Section.

Section 2: That with the aforesaid inclusion of Code of Ordinance Section 93-50, Garage Sales, into the Appendix provided for Code of Ordinance Section 101-01, Supplemental Code Enforcement citation System, any and all violations of Code Section 93-50 may be prosecuted in accordance with the provisions and procedures provided in Code Section 101-01.

Section 3: That the provisions of this resolution shall become effective immediately upon adoption.

PASSED AND ADOPTED by the City Council of the City of Miami Springs, Florida, this 14^th day of April, 2003.

The motion to adopt the foregoing resolution was offered by Vice Mayor Elza, seconded by Councilman Youngs, and on roll call the following vote ensued:
