RESOLUTION NO. 2003-3212
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS ESTABLISHING APPROPRIATE AND PROPER GUIDELINES AND PROCEDURES FOR CONDUCTING ELECTIONS WITHIN THE CITY; EFFECTIVE DATE
WHEREAS, the City Administration and City Council received a number of complaints regarding the manner in which the last regular City election was conducted; and,
WHEREAS, the City Council has expressed its desire to ensure that the polling places in the City are maintained and operated in a manner that permits citizens to vote with as little difficulty as possible; and,
WHEREAS, it has become both necessary and proper to establish procedures that will accomplish the desires of the City Council on election days; and,
WHEREAS, the guidelines and procedures to be implemented on election days are consistent with the State mandated policy of maintaining good order at the polls; and,
WHEREAS, it is the further intent and desire of the City Council to ensure that the procedures to be established and implemented do not infringe upon or unlawfully restrict the ability of candidates, supporters, voters, or citizens to exercise their rights of expression or to peacefully assemble; and,
WHEREAS, the City Council is cognizant that the rights of free expression and the right of each citizen to vote without disruption, unruly behavior, or physical impediment must be weighed and balanced appropriately; and,
WHEREAS, the City Council of the City of Miami Springs has determined that it is in the best interests of the City and its citizens to establish appropriate and proper guidelines and procedures for conducting elections within the City:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS, FLORIDA:
Section 1: That the City Council of the City of Miami Springs hereby adopts the appropriate and proper guidelines and procedures for conducting elections within the City set forth in Exhibit “A” attached hereto.
Section 2: That the provisions of this Resolution shall become effective immediately upon adoption.
PASSED AND ADOPTED by the City Council of the City of Miami Springs, Florida, this 24th day of February, 2003.
The motion to adopt the foregoing resolution was offered by Councilman Caudle, seconded by Vice Mayor Youngs, and on roll call the following vote ensued:

EXHIBIT “A”
The following guidelines and procedures shall be utilized in all City elections.
· The City shall create an artificial “corridor or avenue” from the entrance of the polling place towards the complex parking area for no more than fifty (50) feet in order to provide voters with an unimpeded, unobstructed, and undisturbed route to the polls.
· The first lane of parking adjacent to the driveway which contains the handicapped parking shall be designated for thirty (30) minute voter parking only on election days in order to permit easier access to the polls for all voters. The middle parking lane will be designated for all day parking. All citizens will be notified in advance of these parking procedures to be utilized on election days. All improperly parked vehicles will be subject to the proper enforcement procedures to be designated by the Police Department.
· The City will ensure that the solicitation of voters is conducted in accordance with the provisions and requirements set forth in Florida Statute Section 102.031.
· The City Clerk, as the City Supervisor of Elections, shall take all reasonable action necessary, as mandated in Florida State Statute, Section 102.031, to ensure order at all City polling places.
Springview Elementary School
· The City Clerk, as the Supervisor of Elections, with the aid and assistance of the City, shall solicit the cooperation and compliance of all appropriate school officials with the election guidelines and procedures previously set forth herein. Although the physical premises of the school are not within the City’s control, all appropriate efforts will be made to secure consistent application of the City’s election guidelines and procedures at all polling locations.
· The City Clerk is hereby authorized to contact and solicit the assistance and cooperation of the Miami-Dade County School Board should such action be deemed necessary or desirable.
· The City Clerk, as the Supervisor of Elections, with the aid and assistance of the City, shall solicit the cooperation and compliance of all appropriate school officials with the election guidelines and procedures previously set forth herein. Although the physical premises of the school are not within the City’s control, all appropriate efforts will be made to secure consistent application of the City’s election guidelines and procedures at all polling locations.
