ORDINANCE NO. 898-2003
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF MIAMI SPRINGS AMENDING CODE OF ORDINANCE SECTION 31.11(C)(1), DELEGATION OF PURCHASING AUTHORITY; BY PROVIDING FOR THE INVOLVEMENT AND ASSISTANCE OF THE CITY PURCHASING AGENT IN AUTHORIZED CITY MANAGER PURCHASES AND BY ADJUSTING THE PURCHASE AUTHORIZATION AMOUNT PROVIDED FOR LOWER LEVEL PURCHASES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; EFFECTIVE DATE.
WHEREAS, the City has maintained the current purchasing authorization amounts for the City Manager since the enactment of Ordinance No. 878-2002; and,
WHEREAS, it is believed that the City Manager, with the assistance of the City Purchasing Agent, can perform certain purchasing on behalf of the City in a more efficient and appropriate manner even if the purchase authorization amount currently provided in the City Purchasing Ordinance is increased for lower level purchases and maintained for all other levels of purchasing authority; and,
WHEREAS, the City Council is desirous of ensuring that all appropriate purchasing procedures are utilized by the City; and,
WHEREAS, the City Council of the City of Miami Springs has determined that the assistance of the City Purchasing Agent and the increase in purchasing authorization for lower level purchases set forth in the City Purchasing Ordinance for the City Manager would provide an appropriate check and balance system for City purchasing activities and would be in the best interests of the City and its citizens:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS, FLORIDA:
Section 1: That the City Code of Ordinance Sections 31.11(C)(1) is hereby amended as follows:
§31.11 Purchasing, Procurement and Sale Procedures

(C) Delegation of purchasing authority. The City Council reserves unto itself the right to award all contracts as a result of competitive sealed bids or requests for proposals. The City Council may, however, delegate to the City Manager and City Purchasing agent the authority to purchase supplies, materials and services, and to award contracts as they may deem in the public interest. In addition, it is the specific policy of the City Council that no contracts for supplies, materials, or services shall be artificially divided in order for any purchase or procurement to fall below a specifically delineated or delegated purchasing authority amount. The City Council hereby delegates its purchasing authority as follows:
(1) The City Manager shall have the authority to purchase supplies, materials
and services, and to award contracts for purchases of supplies, materials and
services when the good faith estimated total cost thereof does not exceed
$10,000 without the prior approval of the City Council. However, purchases by
the City Manager in excess of Five Thousand ($5,000.00) Dollars which do not
exceed Ten Thousand ($10,000.00) Dollars shall only be permitted following
receipt of at least three (3) prior written price quotations . by the
City Purchasing Agent and submission to the City Manager for selection,
while purchases in excess of One Thousand ($1,000.00) Five Hundred
($500.00) Dollars which do not exceed Five Thousand ($5,000.00)
Dollars shall only be permitted following receipt of at least three (3) prior
verbal price quotations . by the City Purchasing Agent and submission
to the City Manager for selection. Purchases not exceeding Five Hundred
($500.00) Dollars One Thousand ($1,000.00) Dollars shall be permitted
without securing any prior price quotations. All purchases and awards of
contracts in excess of $10,000 must be approved by the City Council before the
purchase or award is made by the City Manager or designee.

Section 2: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed insofar as they are in conflict.
Section 3: That this Ordinance shall take effect in the manner provided by law.
