AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS, FLORIDA AMENDING CODE OF ORDINANCE SECTION 102.01 - RE-OCCUPANCY CERTIFICATION, BY ADDING THERETO CERTAIN EXPLANATIVE LANGUAGE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; EFFECTIVE DATE.
WHEREAS, since the enactment of Code Chapter 102, Re-Occupancy Certification, numerous residential occupancy inspections have been conducted by the City; and,
WHEREAS, the practical application of the legislation has proved that it is both workable and effective in detecting violative conditions; and,
WHEREAS, although certain interpretative questions have arisen during the implementation of the ordinance provisions, all such questions have been appropriately addressed and resolved by the city's staff; and,
WHEREAS, despite the foregoing it appears that certain language needs to be added to the ordinance in order to prevent any conflict as to the effective period for the re-occupancy certificates issued by the City; and,
WHEREAS, the City Council of the City of Miami Springs has determined that the addition of the proposed language to Code of Ordinance Section 102.01 is both necessary and appropriate and in the best interests of the city and its citizens:
N OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI SPRINGS, FLORIDA:
Section 1: That Code of ordinance Section 102.01, Re-Occupancy Certification, is hereby amended as follows:
CHAPTER 102: RE-OCCUPANCY CERTIFICATION.
102.01 - Re-Occupancy Certification.

(6) Re-occupancy Certificates issued following initial inspections or reinspections shall remain effective for forty-five (45) days from issuance. The effective period for such certificates may be extended one time for an additional forty-five (45) days upon the payment of an extension fee to be established by City Resolution. If the subject premises is not transferred or conveyed, and the re-occupancy certification recorded, within the effective period of any Re-occupancy Certificate, the owner/seller shall be required to re-apply for a new Re-occupancy Certificate. The amount of the fee charged for the extension of the effective period of any Re-occupancy Certificate may be amended from time to time as determined to be required by the City.

Section 2: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed insofar as they are in conflict.
Section 3: That this Ordinance shall become effective immediately upon adoption.
